Madras High Court Confirms Rs 1.5 Crore Tax Penalty on Actor Vijay
The Madras High Court has delivered a significant ruling, confirming the Rs 1.5 crore fine levied on popular Tamil actor Vijay by the Income Tax Department. The court dismissed Vijay's petition challenging the penalty, stating unequivocally that the fine is legally valid and requires no judicial interference.
The bench emphasized that at no stage has there been any procedural irregularity or grounds for intervention, thereby fully endorsing the stance of the Income Tax Department. This decision marks a crucial development in a long-standing financial dispute involving the actor.
Origins of the Tax Case: The 2015 Investigation
The case traces back to 2015 when income tax authorities conducted searches at Vijay's residence and workplace. During these raids, officials uncovered documents revealing discrepancies in his declared income.
According to reports, Vijay had filed an Income Tax Return (ITR) for the fiscal year 2015-16 disclosing earnings of Rs 35.42 crore. However, this figure notably excluded approximately Rs 15 crore in revenue generated from the film Puli. The Income Tax Department classified this omitted amount as undisclosed and concealed income, leading to the imposition of the Rs 1.5 crore penalty through an official order in June.
Legal Challenge and Court's Rationale
Vijay subsequently challenged the penalty under the Income Tax Act, filing a petition in the Madras High Court. The court had previously granted an interim stay on the tax demand while the matter was under review.
During proceedings, Vijay's legal counsel argued that there was an undue delay in passing the penalty order, which they contended should result in its quashing. In response, the Income Tax Department maintained that the order was issued within the prescribed statutory time limit, thereby refuting claims of delay.
After carefully considering both arguments, the high court bench ruled in favor of the tax authorities. The petition was dismissed, and the Rs 1.5 crore penalty was upheld. The court clarified that Vijay retains the liberty to pursue further legal recourse by filing an application before the Income Tax Appellate Tribunal if he chooses to do so.
