Haryana Government Constitutes High-Powered Committee to Overhaul Teacher Transfer Framework
The Haryana government has established a high-level committee to comprehensively review its online teacher transfer policy framework, following sharp observations from the Punjab and Haryana High Court. The committee has been given a strict deadline of April 17 to submit its detailed report and recommendations.
Court Intervention Sparks Policy Review
This decisive action comes directly in response to critical observations made by the Punjab and Haryana High Court while hearing a batch of writ petitions. Earlier this month, the court had questioned the fundamental rationale behind the existing transfer criteria, noting particular concerns about the weighting system.
The court specifically highlighted that the current policy appeared "wholly irrational" in assigning 75% weightage solely to an employee's age while limiting all other relevant factors collectively to just 25%. This disproportionate emphasis on age as the dominant factor raised serious questions about the policy's fairness and effectiveness.
Committee Composition and Mandate
The human resources department issued the formal order on April 7 from Chandigarh, signed by Chief Secretary Anurag Rastogi, constituting the review committee. The panel comprises senior officials from multiple departments:
- Additional Chief Secretary (Appointments)
- Director Generals of Higher and Secondary Education
- Director of School Education
- Key officials from finance, prosecution, and NIC departments
- Allied department representatives
The director of the human resources department has been designated as the convenor of this significant committee.
Specific Tasks Assigned to the Panel
The committee has been entrusted with several crucial responsibilities:
- Reviewing existing provisions of the teacher transfer policy in light of the court's concerns
- Recommending suitable modifications to address identified shortcomings
- Suggesting further changes if required for policy improvement
- Examining the way forward for ongoing and proposed transfer drives
Court's Rationale and Policy Context
While hearing petitions including Vinod Kumar and another vs State of Haryana and others, the High Court emphasized that although the state has the prerogative to frame transfer policies, these must rest on rational and balanced considerations. The court noted that the state had earlier assured a relook at the issue, but subsequent explanatory material failed to satisfactorily address the concerns raised.
The court highlighted widely accepted parameters in transfer frameworks that should receive proper consideration:
- Length of stay at a particular station
- Spouse postings and family considerations
- Medical conditions requiring specific locations
- Employees nearing retirement age
- Administrative and operational needs of schools
The court indicated that overreliance on age as a dominant factor may not be justified when balanced against these other important considerations.
Background of Haryana's Online Transfer System
The Haryana online teacher transfer policy, implemented through a digital system in recent years, represents a points-based mechanism designed to bring transparency and reduce discretion in teacher postings across the state. Under this system, teachers apply for transfers through a dedicated digital portal and receive station allocations based on a comprehensive score derived from various criteria.
The scoring system considers multiple factors including:
- Teacher's age
- Tenure at current posting location
- Hardship categories of different regions
- Various service-related factors
This policy plays a crucial role in ensuring equitable distribution of teachers between urban and rural schools, addressing critical vacancies, and managing staff requirements in government schools throughout Haryana. The current review aims to refine this system to better serve both educational needs and teacher welfare.
